Terms & Conditions
We, us or our refers to Forever Dreams Bridal & Prom Boutique.
You or your refers to the person buying the goods or services from us.
Garment or goods means any item purchased from Forever Dreams Bridal & Prom Boutique.
The Terms:
In buying goods from Forever Dreams Bridal & Prom Boutique you are legally bound by the contract and any other terms which are discussed and agreed to the extent that they are not in dispute with this contact unless evidenced in writing.
You may only buy goods and services from Forever Dreams Bridal & Prom Boutique for non-business reasons.
The Garment:
A made to order garment is any garment that is not purchased ‘off the peg’ and has to be ordered by us. The size ordered is determined by the largest measurement, so alterations are typically required. Once an order has been accepted and deposit paid, any changes to the order will incur a charge.
The repair or cleaning of any stains or damage that occurs to dresses during the fitting or trying on, is the sole responsibility of the customer.
Sample sale pieces are sold as seen and are non-transferable and non-refundable.
Timing:
During the order process we will let you know when we will provide the goods to you. Unless a fixed date for delivery has been agreed in writing, we will deliver the goods within a ‘reasonable amount of time’, taking into account the location the goods are sourced from. By way of guidance only, goods that are not in stock typically take up to 6 months to arrive and can take longer during peak periods.
If under 6 months there will be a “rush through” charge which will be required to be paid upon collection of the dress.
It is the sole responsibility of the bride to order the goods in time for them to arrive before the wedding.
We are not responsible for delays outside our control. If our delivery of the goods is delayed by an event outside our control, then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay in that we cannot fulfil the contract by the date of your wedding, you may contact us to end the contract and receive a refund for any products you have paid for but not received.
Collection of Goods:
You are responsible for the goods when you collect them from the boutique, until which point they remain the property of Forever Dreams Bridal & Prom Boutique. Once we receive your dress we will contact you to arrange a Collections Appointment. We require the collection of your garment within 2 weeks of it arriving at the boutique. Please note that you will be charged a Holding fee of £1 per day for us to store your dress if collection can not be arranged within 2 weeks.
If you do not collect the goods from us as arranged we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may terminate the contract.
Once your dress has been collected Forever Dreams Bridal & Prom Boutique are not responsible for any damage that may occur. Changes and variations in fabric shades do occur and are beyond the control of Forever Dreams Bridal & Prom Boutique. Extra care should be taken with dresses that have heavy beading or lace to minimise damage and distress to the dress.
In the unlikely event that customers paid for products are lost or damaged, due to fire, flood or theft, whilst on our premises we shall only be responsible for reimbursing the retail costs of such products.
Ordering, Payments & Charges:
We will let you know the cost of goods and services and any extra charges to the fullest extent we can when you place an order with us. Once a price has been quoted, the deposit taken and paperwork signed, a binding order will be in place.
A 50% deposit will be taken upon ordering of the garment. This deposit is non-refundable and cannot be transferred to any other goods and services.
The remaining balance must be paid in full 2 months prior to your wedding date. If you do not pay us for the goods when you are supposed to and you still do not make payment within 7 days of us reminding you that payment is due, we may suspend supply of the goods until you have paid us the outstanding amounts. We will contact you to tell you we are suspending supply of the goods.
You will not be able to collect your garment, until payment is made in full.
The price of goods and services quoted at the outset will be in pounds sterling (£) and does not include any costs associated with changes or additions requested by the customer for any reason, including the cost of further fittings and costs incurred by weight loss or gain. These costs will be payable in addition to the agreed price at the appropriate time.

Cancellation & Termination of Contract:
We may end the contract if you break it. We may end the contract for goods and services at any time by writing to you if:
(a) You do not make any payment to us when it is due;
(b) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the goods;
(c) you do not, within a reasonable time, collect the goods from us.
If we end the contract in the above situations we will not refund any deposit you have paid for the Products.
Unless there is a fault with the goods, which in the case of bespoke items cannot be repaired, you will not be entitled to an exchange or refund of products purchased from us.

Alterations:
It is typical for bridal dresses and prom dresses to require alterations to get the perfect fit. Forever Dreams Bridal & Prom Boutique offers an in-house alterations service. There is an additional charge for any alterations carried out by us.
We shall not be responsible for any services provided by a third party, whether or not such third party was recommended by us.
Limit on our Responsibility to You:
Except for any legal responsibility that we cannot exclude in law or arising under applicable laws relating to the protection of your personal information, we are not responsible for:

Any losses that were not foreseeable to you and us when the contract was formed. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

Any losses, distress, or otherwise caused by the garment.

Any losses that were not caused by any breach on our part.

Actions by third party seamstresses.

Actions by third party cleaners.

Liability for you not fitting the garment as a result of weight gain or loss, pregnancy or any other reason outside of our control.

Any minor variations or irregularities to the finished garment as a result of the natural vagaries of silk or any other material used.
Privacy & Your Information:
We will use the personal information you provide to us:
(a) to supply the goods to you;
(b) to process your payment for the goods; and
(c) if you agreed to this during the order process, to inform you about similar products that we provide, but you may stop receiving these communications at any time by contacting us.
We will only give your personal information to other third parties where the law either requires or allows us to do so.
Other Information:
If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment later.
